CLARKSBURG, W.Va. — A Buckhannon City Council member indicted last week in a federal child pornography investigation will stay in custody following his detention hearing Monday.
David Walter McCauley, 66, entered a plea of not guilty to two counts of production of child pornography and one count of possession of child pornography.
The defense said McCauley was helping a troubled young person by taking him into his home and making him an extended family member. Today, the youth is an adult who still lives at McCauley’s Buckhannon home.
The prosecution told the judge they had evidence that McCauley met the youth on social media, groomed him, and ultimately produced pictures and video of the two engaged in sex acts.
The defense told the judge McCauley could stay at his daughter’s Bridgeport home through the trial and used a series of witnesses to make that case.
The hearing was recessed when the possibility of testimony for the victim was proposed and defense suggested he should be appointed legal counsel as well.

A pre-trial conference is scheduled for Dec. 2 at 12:30 p.m. at the federal court facility in Clarksburg.
