FAIRMONT, W.Va. — A Marion County couple have been arrested for allegedly sexually abusing a child.

Cody Offen, 36, and Evelyn Offen, 26, have been charged with sexual abuse by a parent, guardian, custodian or person in a position of trust to a child.

Evelyn is being held on one count of first-degree sexual assault, one count of first-degree sexual abuse and two counts of sexual abuse by a parent, guardian, custodian or person in a position of trust to child. Cody is being held on one count of sexual abuse by a parent, guardian, custodian or person in a position of trust to child.

According to West Virginia state law, sexual abuse occurs when a person subjects another person to sexual contact without their consent due to physical force, threat or intimidation, whereas sexual assault is sexual intercourse or sexual intrusion without consent.

The West Virginia Division of Corrections stated that Evelyn was booked into the North Central Regional Jail on Wednesday while Cody was booked on March 14th.

Both Evelyn and Cody have bond set at $250,000.
