FAIRMONT, W.Va. — A Marion County judge officially denied the motion to dismiss the charge against former Bridgeport councilman and investigator Lowell “L.J.” Maxey for operating as an investigator without at license.
The motion was denied on Wednesday after Maxey filed a motion to dismiss earlier in the fall. Maxey was charged for operating as a private investigator without a license for Attorney Elgine McArdle in her defense of alleged Pagan president Ryan Lane, who recently took a plea deal. In the motion to dismiss the charge, Maxey stated that everything that he did was legal and Marion County Assistant Prosecuting Attorney Sean Murphy is trying to intimidate and defame him with the charge.
A pre-trial hearing is set for January 21st at 1:30 p.m., and a trial is set for March 4th.
