Civil suit filed in WVU fraternity pledge’s death

MORGANTOWN, W.Va. — A New York family is suing a number of groups in the death of their son, a pledge who died in November from alcohol poisoning during a party at a fraternity.

The civil complaint filed in Monongalia County Circuit Court points fault at Kappa Sigma Fraternity, WVU and fraternity members.  You can read the entire filing by clicking here.

Nolan Burch, 19, of Williamsville, N.Y. had a blood alcohol level six times higher than the legal limit for driving in West Virginia when he taken to the hospital
from the downtown Morgantown fraternity house.

According to the complaint, Burch was pressured to drink.

Fraternity members Jordon Hankins and Richard Schwartz face misdemeanor charges in the death.

The suit claims negligence in the freshman’s death.
