Broadband company sues Morgantown

CLARKSBURG, W.Va. – DBI Networks LLC, dba Clearfiber, has filed a complaint against the city of Morgantown in the Northern District of West Virginia.

The law suit claims the city is breaking state and federal law by not allowing access to the public right-of-way to install telecommunications equipment on existing utility poles that are owned by third parties.

DBI Networks has accused the city prohibition of services and bar to entry violation, discriminatory management of public right-of-ways and violation of due process.

DBI Networks is seeking all reasonable sums due, attorney fees and court costs. Adam McCoy from McCoy Injury Law is representing the plaintiff.
