Guilty verdict on lesser charges reached in Marion County murder case

FAIRMONT, W.Va. – It took a jury in Marion County 45-minutes to convict David Lewis of second degree murder and possession of a firearm while committing a felony in the shooting of Dylan Harr in August of 2020.

Prosecutors charged Lewis with first degree murder, but after hearing defense arguments jurors settled on the lesser second degree murder charge. The defense called no witnesses, but argued the physical evidence did not meet standard for a first degree murder conviction.

Lewis faces a maximum of 50 years in prison. No sentencing date has been set.

In August of 2020, Lewis and Harr got into a verbal altercation on Bryant Street when Lewis shot Harr in the chest. Harr was transported, but died later at a Fairmont hospital.
