Know the law before discharging fireworks in Morgantown

MORGANTOWN, W.Va. Revelers in Morgantown are reminded about the safe and legal use of fireworks this Fourth of July weekend.

City fire marshal Jason Quinn said the difference between state law and local ordinance might not be clear, especially for newcomers to the community.

“The local ordinance still makes fireworks that leave the ground, propel into the air, and explode illegal in the city limits,” Quinn said.

The ordinance does allow “novelty” fireworks, or things like snakes, waterfalls, smoke, and sparklers, to be ignited within city limits.

Even when using legal fireworks, Quinn said they should be done away from vegetation, on a hard surface, and at a safe distance from structures. Fireworks should never be used by children or people who are intoxicated. Having access to water near the site is also a good idea, and never pick up or try to re-ignite a firework that fails to light.

Because of their popularity, Quinn especially urges caution when using sparklers.

“It’s a metal rod burning at a very high temperature,” Quinn said. “So, someone could get burned, someone could get something in their eyes, and setting that metal rod down on something could start a fire.”

Quinn said a violation of the ordinance can result in a fine or even a charge of arson, depending on the situation. The person setting the fireworks off could be held responsible for any property damage as well.

“If it were to land on something, in a gutter and start a fire, or land on a hillside and start a fire, ultimately you would be responsible for what happens after that firework leaves your hand,” Quinn said.

According to Quinn, the best way to enjoy fireworks on the Fourth of July is to let the professionals put on the show for you.

The city of Morgantown will hold a Fourth of July celebration at Hazel Ruby McQuain Park on Saturday, July 1 from 5 to 10:30 p.m., with fireworks at 10 p.m.

“Have a good time with those large displays and stay away from the illegal fireworks. Enjoy the novelty fireworks, but do it all with caution and responsibility,” Quinn said.
