Second suit filed against former WVU student convicted in fatal DUI

Carli-Sears-e1453119927213-650x350MORGANTOWN, W.Va. — The other woman walking with former Charleston native Carli Sears at the time of her death in Morgantown has filed a lawsuit against Alexander Hambrick.

Madeleine E. Wymer filed the suit late last week against Hambrick, who was convicted of getting behind the wheel of a vehicle in Morgantown in 2016 before fatally hitting Carli Sears with his car. His parents, Kimberly Hambrick and Brad Hambrick were also named in the suit, which also includes DC LLC/Jameson’s Annex, DC LLC owner and operator Michael S. Schuman, and real estate owner Thomas H. Vanlandingham. Jameson’s Annex on High Street, located at property owned by Vanlandingham, permanently closed last year.

Wymer is suing the defendants named in this filing for “permanent and severe physical and mental injuries.” She’s asking for relief and damages for past and future medical bills, past and future physical pain and suffering, past and future mental pain and suffering, loss of enjoyment of life, punitive damages, attorney fees and costs, and such other incidental damages as may be determined through litigation.

Alexander Hambrick, 22, pleaded guilty in Dec. 2016 to a pair of felony charges in connection to the deadly hit and run adjacent to Stewart Street in Morgantown in Jan. 2016. Wednesday marked the two-year anniversary since Sears’s death. She was 20 years old.

Hambrick’s 20-year maximum sentence is suspended pending completion of a program at the Anthony Correctional Center.

Sear’s family also filed suit against Hambrick, DC LLC, Jameson’s Annex, Michael S. Shuman, and Thomas H. Vanlandingham in Dec. 2016, just days before Hambrick pleaded guilty.
