State attorney general disputes Mylan settlement agreement

MORGANTOWN, W.Va. — The West Virginia Attorney General is arguing a proposed settlement by Mylan over Medicaid payments is a “sweetheart deal”.

Mylan announced the company would pay $465 million after the pharmaceutical company was discovered to be paying rebates at generic drug rates instead of brand name drug rates.

It has been argued that Mylan’s EpiPen Auto-Injector wasn’t properly classified with the Centers for Medicaid and Medicare services which kept the company from paying higher rebates to Medicaid.

State Attorney General Patrick Morrisey alleges Mylan might owe up to $700 million.

Morrisey addressed his complaint to the U.S. Department of Justice.
